K-SWOC/UE NLRB Election Update

The Kenyon administration has filed an additional motion attacking the legal right for student workers to hold a democratic union election, in an attempt to delay our election indefinitely. The College's continued insistence on denying our right to a vote is an insult to Kenyon student workers and a threat to the rights of tens of thousands of unionized student workers across the U.S. By doubling down on baseless arguments surrounding FERPA, Kenyon's latest motion attacks the legal precedent (Columbia 2016) that gives all student workers in this country the right to hold union elections. Over 80,000 graduate and undergraduate student workers have unionized through the NLRB, state labor boards, or related processes since the Columbia decision (2016), and no university or College involved has been found to be in violation of FERPA. Most recently, Hamilton College Admissions Tour Guides and Senior Fellows unionized this fall, and Hamilton College has not been found to violate FERPA by providing the NLRB with basic directory information. We see no reason why Kenyon College would be an exception to this pattern. On Monday, November 29, our UE-provided counsel notified NLRB region 8 of our intent to respond to the administration's

latest motion. Once filed, we will share this response with the Kenyon community in its entirety.
